BCCI files plea in Supreme Court

The BCCI has appealed the ruling of the Bombay High Court which declared the appointment of the independent probe panel “illegal and unconstitutional,” in the Supreme Court of India

The BCCI has filed a special leave petition (SLP) in India’s Supreme Court against the ruling of the Bombay High Court declaring illegal and unconstitutional the board’s appointment of the independent inquiry commission. The petition has claimed, among other issues, that the rules the board was deemed by the high court to have violated in setting up the commission were not mandatory or absolute.The original petitioners, the Cricket Association of Bihar, had already filed a caveat with the Supreme Court to enable it to be a part of any appeal filed by the BCCI.In the 13-page petition, the BCCI has sought to contest the High Court order on various grounds including its decision to entertain the PIL given the board’s status as a private body; it has sought to challenge the petitioner’s right to file a PIL and question the legality of the inquiry panel when it was not even part of the BCCI nor, therefore, subject to the findings of the inquiry commission. It has also sought to challenge whether the High Court could make a declaration when no relief of any kind was sought.In their 61-page order delivered last Friday, Justices SJ Vazifdar and MS Sonak had held that BCCI had violated its own constitution – specifically Rule 2.2 of the IPL Operational Rules, which mandated that at least one member of the league’s Code of Behaviour Committee needed to be on the inquiry panel. Although Sanjay Jagdale, the former BCCI secretary and part of the Code of Behaviour Committee, was on the original three-member commission, the BCCI did not name a replacement once he resigned. “In other words a commission cannot be constituted without at least one member of the IPL Code of Behavior Committee,” the order noted.However the BCCI’s contention in its petition is that while the High Court had declared that it was the board’s “prerogative” under the IPL Operational Rules 2013 to appoint an inquiry commission and not for the court to pass an order, “it has erred in commenting on and finding that the probe commission as constituted was against the internal rules of the Petitioner.”The BCCI is also contending that the IPL Operational Rules, which the High Court had said it (BCCI) had violated were not “mandatory” or “absolute” and the board had the authority to modify them. “It is submitted that rule 2 (1) of the said rules specifically states that ‘all complaints and/or breaches of the Regulations or charges of misconduct under the Regulations and any dispute between a player and franchise in respect of such player contract shall (unless BCCI in its absolute discretion decide otherwise) be decided by BCCI in the manner set out below’,” the SLP said. “It is submitted that the manner of setting up commission/panel as set out in the Operational Rules are not mandatory since they can by the express terms of the Rules themselves be altered by the BCCI.”It also stated that the High Court had failed to appreciate that the inquiry commission comprised two “independent” members. “It is submitted that the committee that was appointed comprised of two retired judges of the Madras High Court, who in fact are outsiders and no way can be said to be interested persons. While so, a Commission consisting of outsiders of the Petitioner (BCCI) with no office bearer or member of the Petitioner itself, being a member of such Committee would in fact be laudatory and give rise to greater transparency,” the SLP said.The Bombay High Court’s ruling, issued last week, was in response to the CAB’s Public Interest Litigation that the two-member panel set up to investigate allegations of corruption in the IPL was constituted illegally. The court had raised questions on the manner in which the panel was constituted, stating that the BCCI had violated its own constitution in the process.The court’s findings came two days after the BCCI’s probe panel comprising retired justices of Madras High Court – T Jayaram Chouta and R Balasubramanian had cleared Gurunath Meiyappan, one of the top officials at Chennai Super Kings, the franchise owner India Cements, Rajasthan Royals’ co-owner Raj Kundra and Royals’ parent company Jaipur IPL Pvt Ltd of “wrongdoing”.

Big PictureScotland haven’t been able to develop a compelling case for more top level cricket, as Ireland have, and as such, their appearances against the big boys of world cricket don’t carry the same “point-to-prove” status. So there should be no ramifications for labelling this fixture an Australian warm-up for the NatWest series against England.Australia need to regain credibility in ODIs. They were roundly written off for the Champions Trophy, thumped by England in their opening match and never realistically threatened the semi-finals. A 3-0 Ashes defeat will have done nothing for their confidence but Ashes losers have recently found solace in the one-dayers that follow. A confidence-boosting defeat of the Scots will gee Australia up nicely.So will a longer memory. In February Australia shrugged off a West Indies side high on their World T20 success which, before last week’s win in the Twenty20 at the Ageas Bowl, was their previous taste of any victory. They can certainly play in their home conditions; a factor which will shorten their odds for the 2015 World Cup. And unless something quite remarkable happens, they should cast Scotland aside.That said, Pakistan were given a scare north of the border back in May and when Scotland can select their first XI, they are a useful side – currently lying joint third in the World Cricket League Championship with two games in hand on second-placed Netherlands. Their posse of county cricketers return for this match although captain Kyle Coetzer is ruled out with a wrist injury.Coezter could also miss the three World Cricket League Championship matches against Ireland which follow this fixture; crucial matches in Scotland’s quest to qualify for the 2015 World Cup. Players to watchWithout Coezter, a huge hole is left in the Scotland batting line-up but a player who can take up the slack is Matt Machan. At 22, Machan could be a Scottish international for some time and hinted at what he could become with 114 against Kenya in June. Misbah-ul-Haq wanted Younis Khan to reach his double-century before calling an end to Pakistan’s second innings but said the senior batsman would have been fine even if the declaration had come before the individual landmark.Misbah declared late on day four as soon as Younis hit Prosper Utseya for six to move from 194 to 200, having lifted Pakistan from 169 for 5 to an imposing 419 for 9 to set Zimbabwe a target of 342. The hosts were dismissed for 120 on the final morning, with Saeed Ajmal and Abdur Rehman taking four wickets each.”I wanted Younis to get to 200 because he really deserved that,” Misbah said. “I told him how many overs I was going to give him. He was (on) 188 at the time and said, ‘no problem, you can declare as soon as you want’. He is a team man and he would not have said anything if I declared before he got to 200 but I wanted him to get it.”Younis was helped by No 7 Adnan Akmal and last man Rahat Ali in building Pakistan’s position, and he acknowledged their roles. “When you’ve played a lot of Test cricket, you know when to block and when to score runs,” Younis said. “I knew that if I batted for most of the day, I could take the lead to almost 300. I had a good partnership with Rahat Ali at the end. He helped me get to 200.”I think he (Adnan) is a much improved player. I just kept saying to him ‘play straight because even though their bowlers are doing well, soon you will get some runs.’ Quickly, he had 20 or 30 and when you have that you can go on and get more. That’s how Test cricket is.”Younis’ unbeaten 200 came after he fell for 3 in the first innings, in his first match for Pakistan in more than five months. He said it was a difficult proposition playing low-ranked teams such as Zimbabwe. “It’s very hard because if you do well everybody expects you to do well and if you don’t do well, people ask you why you didn’t do well,” Younis said. “At the end of the day, it is Test cricket and they are playing it because they are good. Look at it, for the first three-and-half days, Zimbabwe won every session and then we just won one or two sessions at the end and we won the match.”Despite taking a 78-run first-innings lead, Zimbabwe were unable to press their advantage and collapsed inside 40 overs on the final day. Younis held the home side’s inexperience responsible for their capitulation. “Teams like Zimbabwe need more Test cricket,” Younis said. “They need to get more experience because that is the only way they’ll know how to go on and win matches. That’s the same for everyone. That’s how you learn, when you play more Test cricket.”Misbah said he knew Zimbabwe would compete but was confident in Pakistan’s ability to recover lost ground. “I expected a fight but I must say they really gave us a tough time,” Misbah said. “They were in control for much of the match but I knew my team is capable of fighting back. I thought as long as we had 100 to 105 overs, we could bowl them out.”As it turned out, Pakistan needed just 46.4 overs to run through Zimbabwe, with Ajmal taking his match tally to 11 wickets. “He is a world-class bowler,” Misbah said. “Without him, I’d say we couldn’t even think of playing. He is a big advantage for us.”With Ajmal in such form and Rehman contributing in the second innings as well, Pakistan did not require the offspin of Mohammad Hafeez. “He is definitely fit for bowling,” Misbah said of the Pakistan Twenty20 captain. “He passed a fitness test before this match. But we wanted to use our frontline spinners and that’s why I didn’t use him.”

After Kraigg Brathwaite and Kirk Edwards fell in the 90s on the first day, Assad Fudadin took his team to a strong total with the tail. Lokesh Rahul and Manpreet Juneja tried to stabilise India after two wickets fell before the score crossed 50, but Nikita Miller removed Rahul to give West Indies the advantage again.Resuming at 264 for 5, West Indies lost Chadwick Walton for 35 to Ishwar Pandey but Fudadin and Miller denied India any further success by putting on 88 for the seventh wicket. Miller struck five boundaries during his 49 before being run-out. Once he fell, with the score at 364, the rest of the tail did not add much but Fudadin took them past 400 with a patient and unbeaten 86 during which he faced over 200 deliveries.Offspinner Parvez Rasool took the remaining three wickets for his fourth five-wicket haul in first-class cricket and finished with 5 for 116.India put on a stable 45 for the opening stand which was broken by left-arm spinner Veerasammy Permaul who had Jiwanjot Singh caught behind for 16. India were given a big blow when they lost captain Cheteshwar Pujara to Miguel Cummins after adding only 3 to the scoreboard and India’s score was only 49. Rahul and Juneja steered the Indian innings with a 60-run stand, taking India past 100, but West Indies struck again when Rahul became Miller’s first victim for 46. Juneja was given company by Harshad Khadiwale for about an hour before stumps during which he made a tolerant 5 off 36.

أكد هوبير فيلود المدير الفني لبوركينا فاسو، أن منتخب مصر يعد المرشح الأبرز للتأهل لكأس العالم 2026 من المجموعة الأولى في التصفيات الإفريقية.

وكانت قرعة تصفيات كأس العالم للقارة الإفريقية أقيمت الخميس الماضي، وأسفرت عن وقوع منتخب مصر في المجموعة الأولى، بجانب بوركينا فاسور وسيراليون وغينيا بيساو وجيبوتي وإثيوبيا.

وقال فيلود خلال تصريحات لبرنامج “الريمونتادا” المذاع على قناة المحور: “مجموعة تصفيات كأس العالم صعبة، المرشح الأبرز للتأهل منتخب مصر”.

وبسؤاله عن اللاعب الذي يخشاه في منتخب مصر، أوضح: “المنتخب المصري في مرحلة بناء مع مدرب جديد لا أعرفه ولكن مصر كانت متواجدة في أمم إفريقيا، وقدمت بطولة جيدة وتأهلت للدور النهائي، واللاعب العالمي المعروف محمد صلاح هو الذي أخشاه، والذي يقدم الكثير مع المنتخب المصري بفنياته الكبيرة”.
